1. Acceptance of Terms

By accessing and using Bantay Proyekto ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. The Platform is operated in accordance with the laws of the Republic of the Philippines.

2. Description of Service

Bantay Proyekto is a public transparency platform that enables:

Citizens to view and track government infrastructure projects
Citizens to submit reports and concerns about project implementation
Government agencies to publish project information and progress updates
Public access to procurement documents and project timelines

3. User Accounts

3.1 Registration: Users may register for an account to access additional features. You must provide accurate and complete information during registration.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Agency Representatives: Users registering as government agency representatives must use their official government email address (.gov.ph) and must be authorized by their agency to publish information.

4. User Responsibilities

Users agree to:

Provide truthful and accurate information
Not submit false, misleading, or malicious reports
Not impersonate government officials or agencies
Not attempt to disrupt or compromise the Platform's security
Comply with all applicable Philippine laws and regulations
Respect the rights and privacy of others

5. Agency Representative Obligations

Government agency representatives agree to:

Publish accurate project information in accordance with RA 9184 and other applicable laws
Update project progress regularly and truthfully
Respond to citizen concerns in a timely manner
Maintain confidentiality of citizen report details as appropriate
Not delete or modify project records to conceal irregularities

6. Citizen Reports

6.1 Anonymous Reporting: Citizens may submit reports anonymously. The Platform will protect the identity of anonymous reporters to the extent permitted by law.

6.2 Good Faith Requirement: Reports must be submitted in good faith based on genuine concerns. Malicious, frivolous, or knowingly false reports may result in account suspension.

6.3 Whistleblower Protection: In accordance with applicable laws, the Platform supports protection for whistleblowers who report genuine irregularities.

7. Intellectual Property

The Platform design, code, and original content are protected by intellectual property laws. Government project data and documents published on the Platform are considered public records in accordance with the Freedom of Information (FOI) policy. Users may use such public information for lawful purposes.

8. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind. While we strive to ensure accuracy, we do not guarantee that project information published by agencies is complete, accurate, or up-to-date. Users should verify critical information through official government channels.

9. Limitation of Liability

To the maximum extent permitted by law, Bantay Proyekto and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Platform. This includes but is not limited to damages arising from reliance on project information or delays in report processing.

10. Termination

We reserve the right to suspend or terminate user accounts that violate these Terms of Service. Users may also delete their accounts at any time. Agency representatives whose accounts are terminated will have their publishing privileges revoked immediately.

11. Changes to Terms

We may update these Terms of Service from time to time. Significant changes will be announced on the Platform. Continued use of the Platform after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these terms shall be resolved in the courts of the Philippines.
